Denver moratorium and where this work is still allowed

As of May 21, 2026, the City and County of Denver has a one-year moratorium on new zoning permits and site development plans for data centers as a primary building use. The pause lets the city develop rules for energy use, water consumption, noise, and siting. Existing operating data centers and projects that already hold construction permits are not stopped by the moratorium. The moratorium generally does not apply to AI server cluster installations inside existing commercial facilities when the data center is not the primary use of the building—for example a retrofit in an office or research facility, or work inside a pre-existing co-location data center. Those secondary-use and in-building projects are the commercial pathway this scope addresses in Denver.
